Master’s Degree in Law

• A bachelor degree in law from a university recognized by Al-Quds university with a grade no less than “Good”.
• Two recommendation letters from professors the student has previously studied with.
• To pass the written exam and the personal interview.

Having a Master degree in legal studies will help to open up a wide range of career opportunities in the following sectors:

1. Justice sectors: judiciary, courts, police, public prosecution, human rights organizations.
2. Privat and public sectors: advocates, and consultants in legal departments.
3. Education sector: lecturers and/or legal researchers at universities, and institutes.

Under this program, students are required to complete (36) credit hours divided as follows:

A. Dissertation Track: students of this track are required to complete (30) credit hours of compulsory and elective courses, and (6) credit hours for the dissertation as follows:

• (18) credit hours of compulsory courses
• (12) credit hours of elective courses
• (6) credit hours – Dissertation

B. Comprehensive Exam Track: students of this track are required to complete (36) credit hours of compulsory and elective courses as follows:

Civil Law (8051501)

The course deals with the general theory of obligation concerning sources of obligation, voluntary (contract and individual will) and involuntary (tort liability, beneficial act, and law), also rules of obligation. The course provides advanced study of specific contracts, their legal regulation, civil liability (tortious and contractual), means of execution whether voluntary or compulsory, and legal methods to protect execution.

Original and Consequential Rights in Rem (8051607)

The course deals with Original and consequential rights, including ownership rights, its definition, limitations, protection, and its special types, rights stemming from ownership including the right of use, benefit, and reside. The course provides advanced study of mortgage, its definition, provisions and regulations of mortgage.

Civil Procedures Law (8051609)

This course provides advanced study of Civil Procedures before courts, it also provides an understanding of the Judicial organization including formation of courts, levels of courts, principles of litigation, litigation proceedings starting from filing a lawsuit up to judgment issuance, regular and exceptional means of appeals.

Labor and Social Security Law (8051610)

This course provides advanced study of the provisions of Labor Law that governs employment relations between employers and employees in the private sector, employment contracts and their main elements, understanding the difference between fixed term employment contracts and unlimited employment contracts, analyzing court decisions. The course also deals with Social Security Law, its origins and evolution, diversity of its application methods in different countries, the covered groups and extent of insurance coverage.

Commercial Law (8051502)

This course deals with general rules of Commercial Law, commercial transactions, commercial contracts, merchant, commercial store. It also deals with merchant bankruptcy regime, its nature, types, and conditions. Management of the assets of the bankrupt Merchant, its liquidation, distribution of the assets between creditors. The role of the court and its assigned judge, the consequences of a judgment declaring bankruptcy on political and civil rights of the bankrupt.

Commercial Companies (8051611) 

This course provides deep understanding of commercial companies, their various types including foreign companies and shareholding ones, their establishment, management, responsibilities. It also provides a detailed, analytical study of company’s contract, bankruptcy, and liquidation.

Local and International Commercial Arbitration (8051612)

This course deals with the general theory of arbitration in the Palestinian Arbitration Law, its types, arbitration agreement, its requirements and conditions and enforcement. The course also provides a detailed, analytical study of International arbitration, the enforcement of international arbitration awards, the legal arbitration system applied by the International Chamber of Commerce. In addition to an advanced study of electronic arbitration.

Public Finance and Tax Law (8051606)

This course addresses the state’s expenditure and revenues, and its budget. The course also provides an advanced study of tax law, income taxation, property taxes, (VAT) value added tax, tax revenues, and public debts.

Insurance Contracts (8052615)                                     

This course Defines the concept of insurance in general, legal regulation of insurance in Palestine, institutional structure of insurance sector in Palestine, insurance contracts, its evolution in Palestine and other Arab countries. The course also deals with the provisions of reimbursement according to the applicable insurance law in Palestine.

Principles of Legal Research (8051637)                                               

This course addresses various skills needed in legal research, drafting skills, analytical thinking, conducting legal research, select a legal topic with a problematic issue that needs to be solved, preparing research proposal. The course also enhances students’ skills in writing and analytical thinking.

Evidences and Enforcement Law (8052613)                                

This course provides deep understanding of the Palestinian Law of Evidence, and Law of Execution, objective and procedural provisions of evidence, types of evidence, its value, burden of proof, the right to prove, the role of a judge in the proof process. The course also deals with the execution process, types of executable documents, compulsory execution procedure, seizure, confinement of the debtor.

Tax Disputes (8051605)     

This course includes an introduction to public finance (public expenditures, public revenues and public budget), it also deals with Tax laws in Palestine (direct and indirect taxes), tax applications in addition to an in-depth study of income tax disputes and customs, also the general financial policy of the state.

Conflict of Laws 8051608))

This course addresses the general theory governing disputes, sources of the governing principles, requirements of applying foreign rules, also prohibitions on applying foreign laws. This course provides an in-depth thorough, analytical and comparative study of referral, public order and international contracts.

Public Rights and Liberties (8051602)

This module includes the nature of public rights and liberties, its evolution and development and its various guarantees. In addition, the course provides a detailed, analytical and comparative study of one of the general part subjects such as the guarantees provided for public rights and liberties, freedom of expression… Etc.

Administrative Law (8051504) 

This module focuses on the general theories governing administrative law, the administrative organizational structure, the nature of administrative functions, the centralized and decentralized administrative structures, administrative tools, public service and administrative decisions. It also provides a detailed, analytical and comparative study of one of the general part subjects such as the public service or the administrative contract or the administrative decisions

Administrative Judiciary (8051603)

The module studies the general theory governing administrative judiciary, its evolution and development, the legality principle and the various types of controls over the works of the administration. Furthermore, the module provides a detailed, practical and comparative study of one of the general part subjects such as the administrative conflicts and disputes.

Criminal Law (8051505)

This course deals with the general theory of crime and punishment, criminal liability, participation in criminal acts and the general rules governing the criminal legal action, its procedures and applicable evidences. The course also provides a detailed, analytical and comparative study of one of the following subjects: criminal liability, participation in criminal action, criminal investigation and political crimes.

Criminal Procedures (8051614)

This course deals with Criminal Procedures Law which includes the initiation of the criminal case, the authorized party to initiate the criminal case, the dismissal of such case, in addition to civil compensation claims related to criminal cases, its parties and conditions. The course also explores various theories such as the jurisdictional theory, nullification and proof. It also deals with various stages of criminal case (the inquiry phase, the investigation phase and the trial phase).

Judicial Applications (8053617)

Practical application of the procedures followed before the courts in order to develop students’ skills in dealing with practical cases. The course also provides an opportunity for students to be trained at courts under the supervision of judges and course professors in order to build and strengthen cooperation relations between the faculty of law and courts.

English Legal Terminology (8051510)

Students will be exploring the most commonly used English legal terms. The course also highlights certain legal issues which would enable them to express their legal thoughts in English, also it will enable them to search for and use foreign legal resources. The various topics explored in this course include: civil liability, criminal liability, contracts, crimes, and the legal system in Palestine and other jurisdictions.

Islamic Governing System (A Comparative Study) (8051604)

The module deals with the various types of constitutions and its applications in addition to the political system in Islam, the Khalifa, his duties, how he is elected and also the elderly system. A substantive part of the module provides a detailed and analytical study of one of the general part subjects such as, Shora and its applications in Islam, democracy in modern political systems, the differences and similarities between such systems.

Constitutional Law and Political Systems (8051601)

The module focuses on the nature of constitutional law, the current constitutional systems, the Palestinian constitutional system and the state as one of the constitutional law topics. The module also provides a detailed and comparative study of one of the general subjects such as the separation of powers principle and constitutional review.

International Public law (8051503)

The module deals with the mains topics related to the efforts being done to institutionalize the rules and Principles governing the various aspects of international law such as the international organizations, international treaties, human rights, international humanitarian law, diplomatic law …etc. Furthermore, it also provides a detailed and in-depth study of one of the general part subjects such as the Taba International Arbitration Case or international terrorism and other related topics.
